These Terms of Service (“Terms”) govern your use of the Physicks website (physicks.pro) and the Physicks WordPress plugin (“the Plugin”). By using our website or purchasing a license, you agree to these Terms.
The service is operated by SANTAQUINTA MALAGA, S.L. (“we”, “us”, “our”) under the brand “Canica Works”.
1. Definitions
- “Plugin” refers to the Physicks WordPress plugin in any of its plans (Free, Pro, Business).
- “License” refers to the right to use the Pro or Business version of the Plugin under the conditions of these Terms.
- “Customer” refers to any individual or entity that purchases a License or uses the Plugin.
- “Site” refers to a single WordPress installation (single domain or subdomain).
2. License grant
By purchasing a License, we grant you a non-exclusive, non-transferable, revocable right to install and use the Plugin under the following terms:
- Pro license: valid for use on one (1) Site.
- Business license: valid for use on up to five (5) Sites.
- Free version: may be used on unlimited Sites at no cost, with the limitations described in our Pricing page.
Licenses are issued per Site, not per user. You may transfer a License between your own Sites at any time by deactivating it on one Site and activating it on another.
3. Subscription and renewal
- Pro and Business licenses are sold as annual subscriptions.
- Your subscription renews automatically every year unless cancelled before the renewal date.
- You will receive renewal reminders by email before each renewal.
- You may cancel your subscription at any time through the customer portal of our payment provider, accessible from the link included in your purchase confirmation email.
- Cancelling stops future renewals but does not refund the current period.
After a subscription expires or is cancelled:
- The Plugin will continue to function on your Site, but you will no longer receive updates or premium support.
- Pro features remain available until the next major version release that may require an active license.
4. Acceptable use
You agree not to:
- Resell, redistribute, or sublicense the Plugin without our explicit written authorization.
- Decompile, reverse engineer, or attempt to extract the source code of any obfuscated or compiled portions of the Plugin.
- Use the Plugin to create content that is illegal, harmful, defamatory, or that infringes the rights of others.
- Use the Plugin in a manner that violates any applicable law or regulation.
- Remove or modify any copyright notices, attribution, or branding within the Plugin’s source code in violation of its license.
5. Updates and support
- We provide updates and bug fixes to all active subscribers throughout their subscription period.
- Premium support (response within reasonable business hours) is provided to active Pro and Business subscribers via support@physicks.pro.
- Free users receive community support through public documentation and forums, with no guaranteed response time.
- We do not guarantee compatibility with every third-party theme, plugin, or page builder, but we make reasonable efforts to maintain broad compatibility.
6. Refund policy
Refunds are governed by our Refund Policy, which forms part of these Terms.
7. Intellectual property
- The Plugin, its source code, design, branding, and documentation are the intellectual property of SANTAQUINTA MALAGA, S.L.
- Some portions of the Plugin are released under open-source licenses (for example, the Plugin uses Matter.js, MIT licensed). These remain governed by their original licenses.
- Content created by you using the Plugin (compositions, designs) belongs to you. We claim no ownership over your creations.
8. Disclaimer of warranties
The Plugin is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not guarantee that the Plugin will be uninterrupted, error-free, or compatible with every WordPress configuration.
To the maximum extent permitted by law, we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of liability
To the maximum extent permitted by law, our total liability arising from or related to the Plugin or these Terms is limited to the amount you have paid us in the twelve (12) months preceding the event that gave rise to the claim.
In no event shall we be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.
These limitations do not apply to liabilities that cannot be excluded under applicable law (such as gross negligence or fraud under Spanish law).
10. Termination
We reserve the right to suspend or terminate your License if you breach these Terms, particularly Section 4 (Acceptable Use) or fail to pay applicable fees.
You may stop using the Plugin at any time. Termination of your License does not entitle you to a refund except as provided in our Refund Policy.
11. Changes to these Terms
We may modify these Terms from time to time. The “Last updated” date at the top reflects the most recent version. For material changes affecting your rights, we will notify active subscribers by email.
Continued use of the Plugin or website after changes take effect constitutes acceptance of the revised Terms.
12. Governing law and jurisdiction
These Terms are governed by the laws of Spain. Any dispute arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of Málaga, Spain, except where mandatory consumer protection law grants you the right to bring proceedings in your country of residence.
